The Plaintiff, Gregory Afoko, invoked the Supreme Court’s original jurisdiction to challenge the decision of the Attorney‑General of Ghana to enter a nolle prosequi discontinuing his murder trial at the High Court. He argued that the decision, made when the trial was almost complete, violated Articles 23 and 296 of the 1992 Constitution of Ghana and was unfair and arbitrary.
